EU Commission sends letter to Meta over ongoing Consent or Pay issues under DMA

The European Commission is considering whether to take further regulatory action against Meta under the Digital Markets Act (DMA), despite issuing a €200 million fine in April for its Consent or Pay business model. The April fine targeted Meta's practices prior to November 2024, before the company adjusted its model to offer a lower price for ad-free access and claims that it would reduce the amount of data used for ad targeting of free users.

The Commission has confirmed that it has sent a letter to Meta regarding "remaining issues" in the ongoing DMA proceeding, but has not specified what they are or confirmed whether Meta's recent changes are sufficient. The Commission indicated it may still impose further financial penalties for continued non-compliance. Meta, which made limited wording and design changes to its ad model in June, has announced its intention to appeal the initial €200 million fine.
