ICO withholds disclosing details about certain reprimands

12/10/2022 | ComputerWeekly

ComputerWeekly submitted a series of freedom of information (FOI) requests to the Information Commissioner's Office (ICO) related to official ICO reprimands primarily issued to criminal justice bodies. The FOI requests follow on from a series of requests submitted by Mischon de Reya that led to a commitment from the ICO confirming it will publish all reprimands it issues from now on. The ICO's information access team responded; however, information about these reprimands was withheld. The reason stated was that "disclosure of the information would be likely to prejudice the ICO's ability to conduct investigations of this nature both now and in the future". Furthermore: "Disclosure would be likely to jeopardise the ICO's ability to obtain information from the organisations we investigate and would inhibit our effectiveness as a regulator. Disclosure of information could adversely affect the relationship we have with them and make them more cautious about engaging with us in the future."
