New UUK guidance on sharing personal data in harassment cases

New guidance for Universities warns against blanket policies involving the disclosure of personal data related to harassment cases, as these are unlikely to be lawful. Instead, Universities UK (UUK) recommends the sharing of personal data from harassment cases should be considered on a case-by-case basis relating to the specific facts and risks. The issue has been a sticky wicket for Universities, given the need to balance the rights of both parties involved. Failures to learn from an earlier harassment report remain and are seen as an obstacle to reporting further incidents. The new UUK guidance consists of a strategic guide for senior leadership and a practical guide when dealing with harassment cases and deciding whether to share personal data. UUK consulted with the Information Commissioner's Office (ICO) on the guidance.
