US Executive Order to prohibit data transfer to adversarial countries

A fact sheet published by the White House has announced that US President Joe Biden will sign an Executive Order barring data brokers from selling the personal data of American citizens to countries of concern. The executive order directs the Department of Justice (DOJ) to develop regulations prohibiting the transfer of data to several adversarial countries, including China, Cuba, Iran, North Korea, Russia, and Venezuela. The types of data types protected under the order include genomic data, biometric data, personal health data, geolocation data, financial data, and certain kinds of personal identifiers. The White House has stated that adversarial nations are accessing vast amounts of Americans' personal data for malicious purposes like blackmail and surveillance, and they could use advanced artificial intelligence systems to advance their goals.

The DOJ responded by confirming that its National Security Division will issue an Advance Notice of Proposed Rulemaking to gather stakeholder feedback on the categories of transactions involving bulk sensitive personal data and government data outlined in the executive order.
