EU Ombudsman rules Commission must disclose CSAM expert list

The European Ombudsman has found that the European Commission's refusal to disclose which experts it consulted on the proposed child sexual abuse material (CSAM) regulation amounted to maladministration. This decision, which was made last month and published this week, originated from a complaint filed in December 2022 by the Irish Council for Civil Liberties (ICCL). The ICCL made two requests for public access to background documents and technical information. While the Commission identified two documents as falling within the scope of the requests and granted partial access, the Ombudsman found that the Commission failed to identify a further document containing a list of experts that fell within the scope of the complainant's requests. The Ombudsman suggested that the Commission re-register the complainant's request for public access and handle it according to the regulation covering public access to EU documents.
