CJEU rules against mass surveilance without limits

In a ruling today the CJEU has ruled against indiscriminate government mass surveillance, making it clear that the national security concerns of Member States do not override the general principles of EU law such as proportionality and respect for fundamental rights to privacy, data protection and freedom of expression. The course has allowed limited use of derogations for a pressing national threat for temporary bulk data collection where it is 'strictly necessary'.  Additional commentary in The Register which outlines how countries will start to develop new interpretations.
