Consultation launched into remit of Scottish Biometrics Commissioner

02/03/2026 | Scottish Government

The Scottish Biometrics Commissioner (SBC) has launched a consultation on whether the regulator's functions remain appropriate in a rapidly evolving technological landscape, and if the list of organisations subject to SBC oversight should be amended.

As an independent regulator established by the Scottish Biometrics Commissioner Act 2020, the SBC provides essential oversight of how policing bodies acquire, use, and destroy biometric data, including fingerprints, DNA, and emerging technologies such as facial recognition software. The review, led by the Scottish Government, fulfils a legal obligation to assess the commissioner's remit five years after the initial appointment of Dr Brian Plastow in 2021.

The consultation closes on 26 May, 2026
