Luxembourg court upholds Amazon's appeal, annuls €746m GDPR fine

An administrative court in Luxembourg has annulled a record €746 million fine imposed by the Luxembourg data protection authority (DPA), the National Commission for Data Protection (CNPD), and referred the case back to the regulator for a review. While the court upheld the substance of the GDPR violations identified in 2021 concerning online behavioural advertising, it found two major procedural shortcomings in the regulator's initial decision.

The court ruled that the CNPD failed to determine whether Amazon's violations were committed intentionally or through negligence, and that the regulator had not sufficiently considered whether a more lenient measure would have been more appropriate than the substantial fine. 

Despite the annulment of the penalty, the CNPD welcomed the court's confirmation of its main regulatory findings. The watchdog stated that its actions have already brought Amazon's advertising practices into full compliance with relevant GDPR provisions. 

In a statement responding to the news, the company said that it was "pleased the Luxembourg Court of Appeal has overturned the CNPD's decision and recognised our position.
