DPC to decide whether to initiate fresh sanctions over TikTok data transfers

The Irish Data Protection Commission (DPC) will decide whether to pursue fresh sanctions against TikTok after the Irish High Court directed it to reconsider a previous suspension order. The order, which stemmed from the €530 million in administrative fines issued by the DPC in May 2025, required the platform to halt data transfers from the EU to China.

While the High Court recently upheld the finding that TikTok breached EU rules, it instructed the regulator to reassess the suspension order because it had not clearly addressed some of TikTok's submissions.

The DPC stated that it will review the judgment before determining whether to initiate a fresh sanctions process.

Meanwhile, a separate judgment regarding TikTok's appeal against the financial penalty has been shared with both parties and will be published shortly.
