European Commission to take France and Spain to court over NIS2 delays

The European Commission is preparing to take France and Spain to the Court of Justice of the European Union (CJEU) over delays in implementing the NIS2 cybersecurity directive. Both countries missed the October 2024 deadline to incorporate EU critical infrastructure law into national legislation, despite receiving two formal reminders.

An anonymous Commission official indicated that the cases are expected to be brought to the CJEU around the summer break and definitely before the end of the year. 

The majority of EU member states missed the original deadline, prompting formal warnings in November 2024 and May 2025. The Commission expects to launch simultaneous court cases against other non-compliant member countries.
