NOYB publishes a detailed Digital Omnibus report

01/12/2025 | NOYB

Since the European Commission published its Digital Omnibus proposal on 19 November, the Austrian privacy and digital rights advocacy group NOYB has been hard at work preparing a 71-page report detailing its thorough analysis of the proposed changes to the EU General Data Protection Regulation (GDPR) and the ePrivacy Directive.

NOYB's subsequent report compares the current EU law with the Commission's proposal, compiling insights into potential problems and inconsistencies. NOYB argues that the proposal shows clear departures from the current logic of the GDPR and existing Court of Justice of the European Union (CJEU) case law. The analysis also discusses the impact on data subjects, authorities, and controllers, offering real-life examples of potential negative consequences.

related article by the Electronic Frontier Foundation (EFF) argues that while the proposal aims to cut red tape and contains some good ideas, namely "improving consent rules so users can automatically set consent preferences that will apply across all sites", ultimately, it concludes that it comes at a high cost through a weakening of GDPR rights.

Meanwhile, Digiday reports European publishers are concerned that the proposals offer little benefit to the sector and, in fact, will make things worse if users are allowed to set tracking and cookie permissions once, in the browser or device settings.
