NOYB files GDPR complaint against online dating app Bumble

Privacy and digital rights advocacy group NOYB has filed a complaint with the Austrian data protection authority (DPA) against the online dating platform Bumble for alleged transparency violations under Article 5(1)(a) of the EU General Data Protection Regulation (GDPR) for misrepresenting the lawful basis it uses for its AI Icebreakers feature. Details contained within an incomplete subject access request (SAR), a violation of Article 15, reveal or at least suggest that the company relies on legitimate interest. This is despite using pressure tactics to nudge users to click "okay" to the AI processing without offering a genuine option to object. Therefore, NOYB claims that Bumble lacks a legal basis under either Article 6(1) and (f), as it has never sought consent, particularly given that explicit consent is required under Article 9 to process sexual orientation data, and that it cannot base its processing on legitimate interest.
