The UK government has proposed an amendment to the Data (Use and Access) Bill (DUA Bill) that would allow charities to send marketing emails and text messages to existing supporters, similar to for-profit companies.
Currently, Regulation 22 of the Privacy and Electronic Communications Regulations (PECR) prohibits unsolicited marketing communications unless the recipient has consented. The new amendment, introduced by Lord Vallance, would expand the exception to charities, allowing marketing as long as it aims to further the charity’s goals and the contact details were obtained when recipients expressed interest or offered support.
