In a piece for Lawfare, Alston & Bird Senior Counsel Peter Swire looks at the recent data transfer developments following Schrems II and the UK's plan to establish independent adequacy decisions. While the EU and US continue to negotiate a new data transfer agreement, Swire notes an increase in enforcement actions against the US following the CJEU ruling last year. Swire also sees the UK facing data protection issues with the EU as it attempts to strengthen its data flows.
