Google Ireland challenges DPC inquiry into data processing complaints

An Irish High Court judge has ruled that Google Ireland's attempt to challenge the Data Protection Commission's (DPC) decision to investigate complaints about the company's handling of personal data should be heard on notice to the DPC. Google Ireland has initiated High Court judicial review proceedings, claiming that the DPC's inquiry is flawed and wants to quash the decision to launch an inquiry under the 2018 Data Protection Act. The DPC opened its single complaint inquiry in October 2020 in response to six consumer agency complaints made against the company. The inquiry is investigating whether Google complied with transparency obligations regarding the processing of personal data during Google account registration and user consent. It also aims to ensure Google's compliance with the EU General Data Protection Regulation (GDPR) during the company's account registration process. Google has challenged the inquiry's validity on several grounds, including the DPC's failure to verify the Google account identifier of each data subject making complaints before launching the inquiry.
