Amendment extending the right to erasure comes into effect

In an article on his personal blog, data protection specilaist jon Baines highlights a significant extension to the right to erasure under the UK General Data Protection Regulation (GDPR) has been brought into effect through the Victims and Prisoners Act 2024 (Commencement No. 10), and Data (Use and Access) Act 2025 (DUA Act) (Commencement No. 8) Regulations 2026 made on 31 March 2026. 

Together, these regulations insert a new Article 17(1)(g) of the UK GDPR, under which individuals can invoke the right to erasure if their personal data was processed following an allegation by a malicious person, provided the controller has investigated the claim and decided that no further action is necessary. 

The new provisions ensure consistency across the UK, as the DUA Act extends these rules to Scotland and Northern Ireland.
