ICO welcomes TikTok Tribunal preliminary ruling

The Information Commissioner's Office (ICO) has welcomed a decision by the First-tier Tribunal (FTT) during a hearing that took place in May 2025, which confirmed that the UK regulator has the power to issue a monetary penalty notice to TikTok. The case is now set to proceed to a full hearing to address the substantive issues raised in TikTok’s appeal.

The ICO had previously issued a Â£12.7 million fine to TikTok in May 2023 for violations of the UK General Data Protection Regulation. The penalty was imposed after it was discovered that TikTok allowed 1.4 million children under the age of 13 to use the service without parental consent, in violation of its terms of service.
