ICO updates international data transfer guidance

14/01/2026 | ICO

The Information Commissioner's Office (ICO) has published an update to its guidance on international transfers of personal information to simplify compliance with the UK General Data Protection Regulation (GDPR). The updated guidance materials introduce a three-step test to help organisations identify restricted transfers and provide clarity on roles and responsibilities, reflecting the complexity of multi-layered data transfer scenarios. To assist businesses that lack specialist expertise, the ICO has added a glossary, quick-reference FAQs, and a brief guide. The updated guidance also aims to support innovation and economic growth by reducing regulatory complexity. Future developments will include interactive tools and additional guidance on cloud services and transfer risk assessments. The regulator will host a webinar on 10 March 2026 to discuss the changes and offer practical advice for those handling or advising on restricted transfers.
