ICO launches international transfers interactive guidance tool

The Information Commissioner’s Office (ICO) has launched an interactive guidance tool to assist organisations with international transfers of personal information. The resource is designed to help controllers and processors, including sole traders and the self-employed, determine if they are making a restricted transfer under the UK General Data Protection Regulation (GDPR).
The tool, modelled on a three-step test, consists of up to six questions and typically takes 10 minutes to complete. It defines a transfer as either sending personal information to a separate organisation outside the UK or making it accessible to such an organisation. Based on user responses, the tool provides brief guidance on the likely application of the law and signposts relevant detailed information.
While public and commercial organisations can use the tool, competent authorities should note that it is not intended for law enforcement processing under the Data Protection Act 2018. Furthermore, the results are not definitive or a substitute for legal advice, and organisations remain responsible for ensuring their processing activities comply with UK data protection law.
