ICO fines Papa John’s pizza company £10,000

The ICO has fined Papa John’s (GB) Limited  £10,000 for sending 168,022 nuisance marketing messages to its customers for unlawfully sending marketing messages to its customers without obtaining adequate consent. Papa John’s relied on the ‘soft opt in’ exemption for marketing consent. However, the ICO ruled this exemption could not be used for customers who had placed an order over the telephone. They were not provided with a privacy notice at the point of contact. Neither were they given the option to opt-out. "Papa John’s telephone customers were not given the opportunity to refuse marketing at the point of contact, which has led to this fine."
