European Commission publishes draft guidance on high-risk AI systems

The European Commission has published its long-awaited draft guidelines to assist AI providers and deployers in determining whether an artificial intelligence (AI) system should be classified as high-risk under Article 6 of the Artificial Intelligence Act (AI Act). The guidelines are also intended to support market surveillance authorities in facilitating the uniform application and effective enforcement of Article 6.
The guidance defines high-risk classification based on two specific scenarios. AI systems are considered high-risk if they function as either a product or a safety component of a product that is covered by the EU harmonisation legislation listed in Annex I. In addition, AI systems are classified as high-risk if they fall within the specific use cases and areas detailed in Annex III of the legislation.
