European Commission launches criminal data retention practices consultation

The European Commission has launched a consultation for an impact assessment (IA) on the retention of data by service providers for criminal proceedings. The purpose of the consultation is to ensure that the IA relies upon "extensive quantitative and qualitative evidence and expertise," and to provide stakeholders with an opportunity to express their views. The Commission is seeking feedback from a range of stakeholders, including:

  • The general public
  • Practitioners operating in public security sectors (justice, home affairs and digital policies)
  • The police and judicial authorities
  • Cybersecurity experts, data protection and privacy authorities
  • Professional lawyers associations, academia, researchers and think tanks
  • Civil society organisations working on digital rights victims' rights, or more broadly on fundamental rights
  • Industry

 The consultation closes on 12 September.
