EU General Court annuls Meta & TikTok supervisory fees under DSA

The General Court of the EU Court of Justice has struck down a 2023 European Commission decision that imposed supervisory fees on Meta and TikTok under the Digital Services Act (DSA). The court ruled in Case T-55/24 that the Commission should have used a delegated act, rather than an implementing decision, to formalise the fee calculation methodology.
Despite the ruling, the court maintained the obligation for both companies to pay the supervisory fees for 2023 for up to 12 months. This provisional period is intended to give the Commission time to properly implement the fees. In a statement, the Commission described the ruling as a "purely formal correction" and confirmed that Meta and TikTok still have to pay the fees.
