EU Commission considering designating ChatGPT as VLOP under DSA

The European Commission is currently assessing whether OpenAI's ChatGPT should be designated as a Very Large Online Platform (VLOP) under the Digital Services Act (DSA). OpenAI recently reported an average of 120.4 million monthly users for ChatGPT's search feature in the EU, far exceeding the DSA's 45 million-user threshold for VLOP designation.

A Commission spokesperson confirmed that they are aware that the reported regional usage has surpassed the legal limit and are reviewing the information. OpenAI clarified that the 120.4 million figure specifically represents users of ChatGPT's online search capability, calculated as a six-month average, and does not include other uses of the large language model.
