Ensuring the fundamental rights of ETIAS applicants
03/11/2025 | EDPS
A blog article by the European Data Protection Supervisor (EDPS) discusses the European Travel Information and Authorisation System (ETIAS) ahead of its launch in autumn 2026. As the launch date approaches, momentum is building to ensure its compliance with fundamental rights, including data protection. ETIAS is a large-scale border management system similar to the US ESTA programme, designed to pre-screen visa-exempt travellers before they arrive at European borders to assess potential security, health, or irregular immigration risks.
The system involves highly sensitive data processing, including the collection of extensive personal information, automated cross-checking against law enforcement databases, and algorithmic profiling.
In the article, the EDPS discusses the role of the ETIAS Fundamental Rights Guidance Board (EFRGB). The EDPS plays an active role in the EFRGB, providing guidance, such as on the right to an effective judicial remedy, which ensures the new system respects the fundamental rights of applicants.
