EDPS releases updated Gen AI guidance for EU institutions

The European Data Protection Supervisor (EDPS) has published updated guidance on the use of generative AI (Gen AI) and the processing of personal data by EU institutions, bodies, and agencies (EUIs). The guidance reinforces the regulators' commitment to helping EUIs comply with their data protection obligations under Regulation 2018/1725, commonly referred to as the EUDPR.

Reflecting the fast-moving technological landscape, the revised guidance offers clearer, more practical instructions for the responsible deployment of Gen AI tools. Key updates include a refined definition of Gen AI, a new action-oriented compliance checklist, and clarified roles regarding whether EUIs act as controllers or processors. The advice also offers guidance on lawful bases,  purpose limitation, and handling data subjects' rights in relation to Gen AI.
