EDPS publishes opinion on importance of data protection for vulnerable people

The European Data Protection Supervisor (EDPS) has issued an opinion on the proposal for a regulation establishing a common system for the return of third-country nationals illegally residing in the EU. In a statement, EDPS Wojciech Wiewiórowski said: "The EDPS acknowledges the need for a more effective enforcement of existing EU and EU Member States' laws in the areas of migration and asylum. At the same time, data protection – as fundamental right listed in the Charter - is one of the last lines of defence for vulnerable individuals, such as migrants and asylum seekers approaching EU external borders. Therefore, the proposed EU-wide approach must be based on full respect for fundamental rights, including the rights to data protection and privacy."
The opinion includes recommendations calling for an in-depth fundamental rights impact assessment to identify and mitigate against potential risks, alongside the right to information for individuals regarding removal decisions, alignment with EU data protection laws, and safeguards for case transfers to third countries.
