EDPB publishes secondary use of personal data for research purposes study

The European Data Protection Board (EDPB) has published the results of a study on the secondary use of personal data in the context of scientific research, particularly in the medical field. The study aimed to provide an overview of international agreements and the laws and practices at both the EU and member states' levels in relation to purpose limitation, lawfulness of processing, and the application of data subjects' rights while taking into consideration transparency obligation exemptions under the EU General Data Protection Regulation (GDPR).

The study's results revealed a lack of consistent approaches among EU member states. To resolve this, the study recommends sharing national practices and interpretations between EU data protection authorities (DPAs) and also that the EDPB develop specific guidelines.
