EDPB and EDPS to issue joint opinion on digital omnibus

During its latest plenary meeting, the European Data Protection Board (EDPB) held a preliminary discussion with the European Data Protection Supervisor (EDPS) on the European Commission’s Digital Omnibus proposal, on which they will issue a joint opinion. While welcoming the focus on effective digital regulation and simplifying EU General Data Protection Regulation (GDPR) compliance for small organisations, the two bodies will analyse the proposal's impact on fundamental rights and legal certainty.

Both the EDPB and EDPS expressed concern that the proposed modification to the definition of personal data appears to go beyond recent case law of the Court of Justice of the European Union (CJEU). As such, they warned that this deviation risks adversely affecting the fundamental right to data protection. The EDPB also noted that implementing CJEU case law through guidelines ensures greater certainty.

Separately, the EDPB adopted recommendations on the legal basis for requiring the creation of user accounts on e-commerce websites, and elected Jelena Virant Burnik as the new EDPB Deputy Chair.
