EDPB adopts opinion on Brazil adequacy decision
05/11/2025 | EDPB
The European Data Protection Board (EDPB) has adopted an opinion on the European Commission's draft decision on the adequate level of personal data protection in Brazil.
The EDPB noted the close alignment between the Brazilian data protection framework and EU legislation. However, the Board invited the Commission to seek further clarifications on several areas, including rules on onward transfers, limitations on transparency, and requirements for Data Protection Impact Assessments (DPIA). The EDPB also requested clarification on the applicability of Brazilian data protection law, the Brazilian Data Protection Authority's powers in relation to law enforcement authorities, and the national security concept in Brazil.
