EDPB adopts LED evaluation report, calls for greater DPA resourcing

The European Data Protection Board (EDPB) has adopted a report supporting the European Commission’s upcoming evaluation of the Law Enforcement Directive (LED), which is due by May 2026. The report, covering the period from January 2022 to August 2025, highlights the LED's vital role in protecting personal data within criminal justice contexts. 

Key recommendations include clarifying the boundary between the LED and the EU General Data Protection Regulation (GDPR). The EDPB also stressed the challenges posed by emerging technologies, such as artificial intelligence (AI), claiming that their use by law enforcement must remain necessary, proportionate, and subject to strict safeguards. In addition, the report calls for reinforcing the roles of data protection officers (DPOs) and for stronger cooperation between competent authorities to improve consistency across the EU.

Separately, the EDPB called for better resourcing of DPAs and adopted recommendations on the application for approval and on the elements and principles in Processor Binding Corporate Rules (BCRs).
