The US Congressional Research Service has released a report on the EU-US Privacy Shield and trans-Atlantic data flows. The report outlines options for the US Congress to facilitate EU-US data flows and a potential enhanced Privacy Shield. These options include considering whether comprehensive national privacy legislation — potentially aligning with the EU General Data Protection Regulation — would “provide some level of certainty to EU businesses and individuals” and “provide sufficient safeguards and guarantees” for U.S. adequacy. The CRS also recommends granting greater enforcement authority to the US Federal Trade Commission.
