CJEU rules on corrective powers of DPAs in personal data breach cases

On Thursday, 26 September 2024, the Court of Justice of the European Union (CJEU) issued its judgment in Case in Case C-768/21 concerning the corrective powers of the data protection authorities (DPAs) in cases of a breach under the General Data Protection Regulation (GDPR). The CJEU ruled that DPAs are not obliged to issue a fine or take corrective action after a personal data breach has been established if the controller has proactively taken necessary measures.
