In March this year, permission was granted by a High Court judge for representative litigation against TikTok to proceed over its handling of children's data. The lawsuit has now been discontinued, following TikTok's application for strike out using the same basis that was fatal to the claim in the Supreme Court's judgment in Lloyd v Google LLC.
The failure of the claim against TikTok is the latest in a series. The question now for anyone considering representative data protection claims is whether success is possible given the Lloyd v Google ruling.
